We do not guarantee specific results or ROI, as marketing performance depends on external variables. 1. GENERAL POLICY
All payments made to Duro Marketing LLC are non-refundable unless explicitly stated otherwise in this policy or in a separate signed agreement. This includes onboarding fees, monthly retainers, strategy development, creative production, and technical consulting.

2. SERVICE DELIVERY DEFINITION
Fulfillment of services is defined as the successful execution and delivery of agreed-upon labor, strategies, and digital assets. Service delivery is deemed complete upon the performance of the work (e.g., campaign launch, delivery of a strategy document, or completion of an audit), regardless of the specific financial or performance outcomes achieved.

3. WORK COMMENCEMENT
“Work commencement” begins immediately upon receipt of payment and includes: onboarding communication, internal team allocation, account audits, and strategy planning. Once work has commenced, services are considered in progress and fees are non-refundable.

4. NON-REFUNDABLE SITUATIONS
Refunds will not be issued under the following conditions:Change of mind after purchase or contract signing.
Dissatisfaction without valid, documented evidence of a failure to deliver the agreed scope of work.
Failure to provide required assets, access, or communication (See Section 11).
Delays caused by the client or third-party approval processes.
Poor campaign performance (e.g., low ROI, leads, or engagement) due to market factors.
Platform-related issues beyond our control (e.g., ad account bans, algorithm changes).
Completed services including strategy sessions, consulting, or audits.

5. 3RD PARTY COSTS AND AD SPEND
Duro Marketing LLC is not responsible for third-party expenses.
Ad Spend: Funds paid to platforms (e.g., Meta, Google, TikTok) are strictly non-refundable.
Software & Tools: Any third-party subscriptions or assets purchased for your project are non-refundable.

6. LIMITED REFUND ELIGIBILITY
Refunds may be considered strictly under the following circumstances:

Duplicate Payments: 100% refund for verified accidental duplicate transactions.
Non-Delivery: If we fail to initiate agreed-upon services due solely to internal issues.
Pre-Work Cancellation: If requested within 48 hours of payment AND no work has commenced, a refund may be issued minus a 10% administrative fee.

7. PARTIAL REFUND CALCULATION CLAUSE
In the event a partial refund is granted, the amount will be calculated based on the following:

Direct Labor: Prorated at an hourly rate of $100 for all work performed.
Asset Value: The value of any strategy documents or creative assets already delivered.
Administrative Surcharge: A 10% fee to cover banking and processing costs.

8. PARTIAL REFUND DETERMINATION
All refund determinations, including the calculation of prorated amounts and the assessment of "work commencement," are made at the sole discretion of Duro Marketing LLC.

9. PERFORMANCE AND PLATFORM DISCLAIMER
We do not guarantee revenue increases, lead volume, or ROI. We are not responsible for ad account suspensions, algorithm changes, or platform outages. These events do not qualify for refunds.

10. RETAINER AND SUBSCRIPTION SERVICES
Cancellation Notice: Written notice is required at least 14 days prior to the next billing cycle.
No Pro-Rata Refunds: Once a billing cycle begins, no refunds are issued for unused time.
Capacity Reservation: Retainers secure our team’s availability. Paused or inactive projects remain non-refundable.

11. CLIENT RESPONSIBILITIES
Clients must provide necessary access, assets, and approvals promptly. Failure to respond to communications within 5 business days may delay services and voids eligibility for any potential service credits or refunds.

12. FORCE MAJEURE
Duro Marketing LLC is not liable for failure or delay in performance due to acts of God, platform-wide outages, government regulatory changes, or other circumstances beyond its reasonable control.

13. CHARGEBACKS AND ADMINISTRATIVE RECOVERY
Initiating a chargeback without first contacting us is a breach of contract. You agree that in the event of a lost or fraudulent chargeback, you will be liable for $500 in liquidated damages for administrative labor, in addition to the original service fee and associated bank fees.

14. GOVERNING LAW
This policy and any disputes arising from it shall be governed by and construed in accordance with the laws of the State of Michigan.
